In the case of a conviction when charges are brought forward by the complainant specifically, rather than through Police investigation, then that should surely be the case, no?

I've read the court files by the way, he's a rapist - the only way that changes is if the girl comes out and says 'nah, my bad, I made it all up' which I'm guessing would've happened sometime between the 1st and 6th times she had to change her identity.

I mean, the bloke actually admitted it. His story is akin to me going 'yeah so, I got the gun right and I shot him in the head.....wait, that's not murder is it?'

I don't know how it works precisely as I'm no legal expert, but when the comments were made he was a convicted rapist, wasn't he? Does the fact the conviction has now been quashed make comments that were made at the time libel? Genuine question.

I believe not, as at the time, as you said yourself, he was a convicted rapist. If one were to now say that Ched Evans was a rapist, then at present (and pending the outcome of the trial) they could then be prosecuted for libel, I believe.

Clearly the biggest oddity is Evans going down for it, but MacDonald walking away a free man, surely if the female in question was unable to give consent to Evans, she was unable to give it to MacDonald, that is the part that's always baffled me.

I think the reason was that she went home with MacDonald implying that he had reasonable reason to believe she had given consent, whereas Evans snuck in a back entrance while she was already in the hotel room. Pretty clear really.

No. Why should it be? Obviously his character has been defamed, but that doesn't mean his alleged victim has acted unreasonably. She clearly has at least some basis for the accusation otherwise the case wouldn't have gone to trial.

We have a justice system for a reason so I don't see why I wouldn't be. He'd still be a thoroughly vile human being though and I'd resent him getting his grubby paws on any compensation. It would also set a worrying precedent.
